Section 3: Applicability Terms and Conditions
• All services and website services offered by the foundation, unaffiliated partners and/or licensors in observing the 'Terms and Conditions'.
• By visiting, using or accessing (whether in person, by computer, e-reader, mobile phone or other electronic device, now or later devised) the Scramble website, mobile website or mobile applications or products, content or other services available on the Scramble website, visitors agree to be bound by these 'Terms and Conditions' and any other additional or other provisions , terms, conditions, rules, and policies that appear or that visitors may be alerted to in relation to the Scramble website (collectively the "Terms and Conditions"), all as may be changed by the company in accordance with these "Terms and Conditions". Without limiting the generality of the foregoing, the 'Terms and Conditions' will also apply if the visitor gains access to the Scramble website or service, as a verified user, via a third party website or social media application (e.g. via Twitter® or Facebook®). These Terms and Conditions, along with any changes or additional or alternative terms or conditions mentioned, will constitute the entire agreement between the visitor and the Company and any prior communication between the visitor and Scramble (including, for example, emails) will not be part of these 'Terms and Conditions'. If the visitor does not agree with these 'Terms and Conditions', visitor should not visit Scramble website or use the services offered.
• Certain trademarks, trade names, service marks and logos used or displayed in the Scramble website are registered and unregistered trademarks, trade names and service marks of the foundation. Other trademarks, trade names and service marks used or displayed in the Scramble website are the registered and unregistered trademarks, trade names and service marks of their respective owners. Nothing in Scramble website grants or may be construed as awarding, by implication, exclusion or otherwise, to be a license or right to use trademarks, trade names, service marks or logos displayed in the Scramble web shop or in use on Scramble website without written permission from the Foundation or any other owner.
• It is the customer's responsibility to determine and comply with all applicable local, national and international laws (including minimum age) regarding the possession, use and sale of a product purchased in the Scramble web shop. By purchasing or placing an order, customer declares that the purchased products will only be used in a legitimate manner. All DVDs and similar products sold are for private and home use (where no entrance fee is levied), non-public display and may not be duplicated.
• In these 'Terms and Conditions', the terms Foundation, Scramble website and Scramble web shop are deemed to include each of their respective officers, directors, employees, shareholders, affiliates, agents, successors or successors.
• Choice of legislation; Jurisdiction. The 'Terms and Conditions', the use of Scramble websites and all related matters are governed solely by Dutch law, with the exception of rules of private international law or the contradiction of laws that would lead to the application of any other laws. Section 4a. Safeguard (Disclaimer)
• Prices: Goods and services may have been priced incorrectly by mistake. Any errors are unintentional. Scramble cannot be required to provide goods or services at an incorrect price.
• Obvious errors or errors in the description or presentation of the offered goods are not binding on Scramble web shop.
Section 4b. Prices
• Goods in Scramble web shop are offered with prices expressed in Euros including the applicable VAT and without VAT.
• Goods and services may be mispriced by mistake. Any errors are unintentional. Scramble web shop cannot be required to provide goods or services at incorrect prices.
Section 5. Tax
• All deliveries within the European Union are taxed on Dutch VAT: 9% VAT for books and magazines and 21% VAT for all other goods and services.
• Scramble offers products and services including VAT, regardless of nationality or country of origin or destination of the customer.
• Scramble offers (*) products and services free of VAT to verified VAT registered companies based in the European Union, outside the Netherlands.
• Scramble charges VAT on goods and services (including shipping costs) delivered to persons with location or delivery addresses within the European Union.
• Scramble does not charge VAT on goods and services provided to verified VAT registered companies with establishment in the European Union, outside the Netherlands.
• Scramble does not charge VAT on goods and services (including shipping costs) delivered to persons or companies with establishment or delivery addresses in countries outside the European Union.
• Customers with establishment or delivery addresses in countries outside the European Union are responsible for the correct import documents and permits and for the payment of import duties, taxes and import controls.
(*) Customers are competent representatives of the company and can thus identify themselves.
6. Scramble webshop
Section 6a. General:
• Products, content and specifications: All features, content, specifications, products and prices of products and services described or displayed on Scramble website, are subject to change at any time without prior notice. Certain sizes and similar descriptions are approximate and are intended to serve convenience. Images of products and services serve as an illustration of products and services offered. All reasonable is done to accurately reflect the characteristics of the products, including the applicable colours. The specifications and colour capabilities of the displays used may cause the real colours to be different than they were experienced on the screen. Colour, texture or detail of the products shown may differ from the current products. All reasonable is done to accurately describe the products. Descriptions may be incomplete or out of date.
• Availability: The inclusion of products or services on the Scramble website at any time does not imply or guarantee that these products or services will actually be available at all times.
• Typing errors: Information on Scramble website may contain tapping or writing errors, inaccuracies, or omissions that may relate to product descriptions, prices, promotions, offers, and availability.
• Corrections: Scramble reserves the right to correct any errors, inaccuracies or omissions at all times without prior notice and to modify or update information or cancel orders when information on the website is incorrect (even after online order has been placed).
• Accuracy of information. Scramble tries to ensure that information on Scramble website is complete, accurate and up-to-date. Despite Scramble's efforts, the information on Scramble's website may occasionally be inaccurate, incomplete or out of date. Scramble does not guarantee the completeness, accuracy or timeliness of the information on Scramble website. For example, products listed on the Scramble website may not be available, may have properties other than those listed, or have a price other than listed on Scramble website. In addition, Scramble can adjust pricing and availability without notice. While it is customary for Scramble to confirm orders by email, receiving an order confirmation email does not automatically mean Scramble' acceptance of an order or confirmation to sell a product or service. • Using the Scramble website. The design of the Scramble website and any texts, images, information, content, and other material displayed on or that can be downloaded from Scramble website are protected by copyright, trademark law and other laws and may not be used except as permitted in these 'Terms and Conditions' or with the prior written consent of the owner of such material. Visitors to the Scramble website are not permitted to reproduce or publicly display, execute or otherwise use the information or material that may be downloaded from Scramble website for any public or commercial purpose. Any unauthorized use of such information or materials may violate copyright, trademark law, laws on privacy and publicity, and other laws and regulations.
• Linking to Scramble website. Creating or having a link from another website to a page on the Scramble website without scramble's prior written permission is prohibited. Displaying Scramble website or information or material displayed on Scramble website in frames or by similar means on another website without scramble's prior written consent is prohibited. Any permitted links to Scramble website must comply with all applicable laws, regulations and regulations.

Neither Scramble nor any of its affiliates guarantees the accuracy or completeness of the information, materials or services provided on or through Scramble website. The information, materials and services offered on or through Scramble website may be out of date, and neither Scramble nor affiliates adheres to or accepts any obligation to update such information, materials or services. The previous exclusions of implicit guarantee do not apply to the extent prohibited by law. Visitors are referred to their local laws for such a ban. All products and services purchased on or through Scramble website are only subject to applicable warranties from their respective manufacturers, distributors and suppliers, where available. To the extent that under the limits of applicable law, Scramble disclaims any liability of any kind, explicitly or implicitly, including any implied guarantees regarding the products and services offered by Scramble. Without limiting the generality of the foregoing, Scramble hereby expressly disclaims all liability for defects to a product due to normal wear, product abuse, product modifications, incorrect product selection, non-compliance with codes, or misappropriation. The previous exclusions of implicit guarantee do not apply to the extent prohibited by law. Visitors are referred to their local laws for such a ban.
• Limitation of liability: Scramble does not accept any responsibility or liability for any damage to or for infection by viruses from the computer, telecommunications equipment or other property of visitors resulting from visitors' access to, use or browsing of Scramble websites, or visitors' downloading of information or materials from Scramble websites. Under no circumstances will Scramble, nor any other party involved in the creation, production or transmission of Scramble websites, be liable to visitors or anyone else for any indirect, special, punitive, incidental damage or consequential damage (including, without limitation, resulting from loss of profit, loss of data or interruption of operations) resulting from the use, inability to use , or the results of the use of Scramble websites, websites linked to Scramble websites, or the materials, information or services provided on one or all websites, either on the basis of warranty, contract or any legal theory and whether or not advised on the possibility of such damage.

Section 6b. Remote Purchases
Conditions to make a Remote Purchase (Order):
• Order is placed by customer by
1. Customer confirmation of goods or services ordered via Scramble website.
2. Scramble Customer Acceptance 'Terms and Conditions'.
3. Full payment by customer of the total amount involved in the order.
• Acceptance by Scramble by
1. Confirmation of receipt of order by Scramble.
2. Confirmation of receipt of payment by Scramble.
• Orders without full payment of the total amount due will not be accepted and will not be processed.
• Scramble reserves the right to refuse orders or agreements without giving reasons.
• Delivery by Scramble follows after the purchase agreement has been concluded.
• Shipping cost contribution depends on destination and size of the order and applies to all orders other than pick-up orders.
• Detailed information about the contribution in shipping costs can be found on the 'shipping costs' page in the Scramble website. They are part of these 'Terms and Conditions'.
Section 6c. Processing orders
• Orders are processed during opening hours.
• Processing and delivery times are indicative and are calculated from the date of receipt of the full payment.
• Provided that all ordered goods are available, orders are sent within two working days.
• If only a part of the ordered goods is available, orders will be sent within two weeks if missing items are expected to be available again within this period of time.
• If only a part of the ordered goods is available, orders will be sent within four working days if the missing items are not expected within a reasonable period of time or at all. Payment for missing items will be refunded.
• Orders are adjusted if one or more items are not available. Payment for missing items will be refunded.
• Scramble is not liable for consequential damage or inconvenience due to incorrect or incomplete information on Scramble website other than the refund of non-refundable or returned items.
Section 6d. Shipping
All orders at Scramble are sent to the address specified by the buyer. All purchases made through Scramble's website are under a shipping agreement. As a result, the risk of loss and claim of goods ordered through Scramble's website passes to the customer when handing over the goods to the carrier. Customer is responsible for filing any claims with carriers for damaged and/or lost shipments.
Postal service (PostNL)
• Mail delivery is carried out under the full responsibility of Dutch postal service PostNL
• Scramble emphatically excludes all responsibility and liability in the event of damage, delay or loss of goods shipped by postal service.
Section 6e. Returned shipments
• It is the customer's responsibility to take such measures so that package will be accepted and signed for receipt at the delivery address or picked up in time at the customer-designated pick-up point.
• Uncollectable or uncollected packages are returned to Scramble.
• Scramble calculates the return shipping costs and any applicable import duties to the customer.
• Additional shipping or delivery attempts are entirely at the customer's expense and responsibility.
Sectione 6f. Warranty and complaints:
• Items purchased through Scramble are defect-free, unless otherwise stated or assumed.
• Complaints must be reported to Scramble immediately and no later than 48 hours after delivery or pick-up.
• Legal guarantee period for goods purchased by residents of countries that are part of the European Union is 2 years after purchase.
• A claim to warranty after 2 years is only considered in accordance with the warranty period and provisions as applied by the producer.
• Guarantee period for goods purchased by residents of countries that are not part of the European Union is equal to the guarantee period as applied by the producer of these goods.
• Warranty expires as soon as the producer can no longer be relied upon by bankruptcy or cessation of production.
• Advertised defects will be repaired or replaced free of charge by Scramble or its suppliers. The warranty is limited to the repair or replacement of the defective part or product and explicitly excludes reimbursement of shipping or import duties.
• The warranty is not valid if, in Scramble's opinion, the defect or damage is due to normal wear and tear, accidental use, or the result of maintenance or modification by other than Scramble approved body.
• Scramble is not responsible or liable for consequential damages.
• Customer should be aware that replacement of damaged, lost or defective goods is not always possible.
Section 6g. Right of withdrawal
• For orders and deliveries to individuals, these individuals have the right to return an item within 14 days (right of withdrawal).
• The withdrawal period expires 14 days after the day on which the item was delivered.
• You can use the right of withdrawal by making this known to Scramble within the 14-day time limit and then returning the items to Scramble within 14 days.
• Items to be returned must be complete including all accessories supplied and in their original condition and factory packaging.
• Return must be accompanied by original or copy of the included invoice.
• Return must be made by courier service at the customer's expense.
• Returns by registered mail will NOT be accepted.
• Upon receipt of the return, the amount of the purchase will be refunded.
• Shipping costs will not be reimbursed.
• The model form can also be used.
Section 6h. Cookies
A cookie is a small computer file or a piece of information that can be stored on the hard drive of the visitor's computer of websites. Scramble websites use cookies to improve the functionality of the websites and in some cases, to provide visitors with a customized online experience. Cookies are widely used and most web browsers are set by default to automatically accept cookies. Visitors can change their internet browser settings to prevent their computer from accepting cookies. Disabling cookies, however, will prevent visitors from experiencing an optimal performance of Scramble websites. Section 6i. Customer Account
Customers who use Scramble services are responsible for monitoring the confidentiality of their account and password and for restricting access to their computer, and accept responsibility for any activities that take place using their account or password. Scramble offers children's products for sale, but sells them to adults who can purchase products with a credit card or other authorized payment method. As Underage users of Scramble services do so only under the supervision of a parent or guardian. Scramble reserves the right to deny services, terminate accounts, delete or edit content, or cancel orders as it is reviewed.
Section 7. Product Disclaimer
Section 7a. General Product Safeguard
The Company provides all services and information, materials, products (including software) and other services to the customer based on the state in which it is located and on the basis of availability unless otherwise specified in writing. The Company shall not provide any guarantee of any kind, expressly or implicitly, with respect to the operation of information, content, materials, products (including software) or other services made available to the customer in any way through Scramble or Scramble, unless otherwise stated in writing. Customer expressly agrees that when using the services and products as provided by the Scramble or Scramble, the risk of use lies entirely and exclusively with the customer.
As far as possible under applicable law, the Company disclaims all guarantees and conditions, expressly or implicitly, including, but not limited to, implied guarantees of title, trading quality and suitability for a particular purpose. The Company does not guarantee that the Company's services, information, content, materials, products (including software) or other services made available through its servers, electronic communications or e-mail are free of viruses or other harmful components. The Company shall not be liable for any damages arising from the use of the Company's services or any information, content, materials, products (including software) or services that are recorded or otherwise made available to the customer through a company service, including, but not limited to, direct, indirect, incidental, criminal and consequential damages, unless otherwise stated in writing.
Section 8. Privacy policy (storage and use of personal data)
The Company stores names, phone numbers, customer email addresses for administrative and commercial purposes. They are used exclusively by Scramble and will under no circumstances be provided to third parties. They are stored on the Company's own secure servers or those of a third party. The Company is committed to maintaining the accuracy, confidentiality and security of the customer's personal data.
· Introduction: The Company is responsible for monitoring and protecting the personal data under its management.
· Purpose of data collection: The Company collects and uses personal information from the customer to provide products or services requested by the customer and to provide the customer with additional services or other products that the company believes the customer may be interested in. In certain cases, the purposes for which personal data are requested are evident, such as providing name, address and payment details as part of the ordering process, and customer consent to the collection of this data is assumed. Name, address, telephone number and e-mail address are provided to delivery services that the Company uses to deliver goods. These delivery services are required to use this data exclusively for the supply of goods to the customer and not to provide it to third parties. In the case of the supply of goods to residents of countries whose authority requires data to be provided for import and charge purposes, invoice and, where appropriate, personal registration data will also be provided to the delivery service.
· Account or customer account: Each customer of the company has their own account in which the following personal information is stored: name and address information, telephone number and email address (= username), subscription newsletter, invoices of previous orders. Customers have the right to access, modify and delete the stored personal data. This can be done by editing data in the customer account on the websites or by request by e-mail or other means of communication.
· Consent: Knowledge and consent are required for the storage, use or disclosure of personal information, unless required or permitted by law. Providing personal information to the Company is always the customer's choice. However, the customer's decision not to provide certain information may limit the ability to provide the company's customer products or services. The Company does not require permission to obtain or use information as a condition for the delivery of a product or service, except where such consent is required to provide the product or service.
· Storage restriction: The storage of personal data will be limited to those data required for purposes as indicated by the Company. With the customer's consent, the Company may request personal information from the customer by phone, email or internet.
· Usage restriction, disclosure and Retention: Personal data is only used or provided for the purpose for which it was collected, unless the customer has consented otherwise, or when it is required or permitted by law. Personal information will be retained for the time it takes for the purpose for which it was collected or required by law.
· Accuracy: Utmost care is taken to keep the stored personal data correctly, fully and up-to-date for use for which they are intended. The customer himself has the opportunity to enter, modify or make his or her data unreadable. In the event that the customer has clearly disabled his or her account, the Company has the right to make it inaccessible or to remove it entirely.
· Safeguarding customer data: Personal data will be protected by appropriate security measures. The Company shall take all reasonable precautions to prevent unauthorized access, use or disclosure of personal information.
· Other websites: Scramble websites may provide links to other third-party websites that are not covered by this privacy policy. Although the Company strives to link only to websites with high privacy standards, this privacy policy will no longer apply once visitors leave the Scramble websites. In addition, the Company and Scramble cannot be held responsible for the privacy practices of third-party websites. Sectie 3: Toepasselijkheid Algemene Voorwaarden
• Alle diensten en website diensten die door de stichting, niet-gelieerde partners en / of licentiegevers worden aangeboden met in achtneming van de 'Algemene Voorwaarden'.
• Door het bezoeken van, het gebruik maken van of de toegang hebben tot (hetzij persoonlijk, door de computer, e-reader, mobiele telefoon of ander elektronisch apparaat, nu of later bedacht) de Scramble website, mobiele website of mobiele applicaties of producten, inhoud of andere diensten die beschikbaar zijn op de Scramble website, gaan bezoekers ermee akkoord gebonden te zijn aan deze 'Algemene Voorwaarden' en alle andere aanvullende of andere bepalingen, voorwaarden, regels en beleid die worden weergegeven of waarop bezoekers attent gemaakt kunnen zijn in relatie tot de Scramble website (gezamenlijk de "Algemene Voorwaarden"), alles zoals door de onderneming kan worden gewijzigd in overeenstemming met deze 'Algemene Voorwaarden'. Andere handelsmerken, handelsnamen en dienstmerken welke gebruikt of worden weergegeven in de Scramble website zijn de geregistreerde en niet-geregistreerde handelsmerken, handelsnamen en dienstmerken van hun respectieve eigenaren. Niets in Scramble website kent toe of mag worden geïnterpreteerd als toekenning, bij implicatie, uitsluiting of anderszins, een licentie of recht te zijn voor het gebruik van handelsmerken, handelsnamen, dienstmerken of logo's weergegeven in de Scramble webshop of in gebruik op Scramble website zonder schriftelijke toestemming van de Stichting of een andere eigenaar.
• Het is de verantwoordelijkheid van de klant om vast te stellen en gehoor te geven aan alle van toepassing zijnde lokale, nationale en internationale wetten (waaronder minimumleeftijd) met betrekking tot het bezit, het gebruik en de verkoop van een product gekocht in de Scramble webshop. Door de aankoop of het plaatsen van een bestelling, verklaart klant dat de gekochte producten uitsluitend zullen worden gebruikt op een wettige manier. Alle verkochte Dvd’s en soortgelijke producten zijn voor privé en thuisgebruik (waar geen entree wordt geheven), niet-openbare vertoning en mogen niet worden gedupliceerd.
• In deze 'Algemene Voorwaarden' worden de termen Stichting, Scramble website en Scramble webshop geacht om elk van hun respectievelijke functionarissen, directeuren, werknemers, aandeelhouders, filialen, agenten, opvolgers of rechtverkrijgenden te omvatten.
• Keuze van wetgeving; Jurisdictie. De 'Algemene Voorwaarden', het gebruik van Scramble websites en alle aanverwante zaken worden uitsluitend beheerst door de Nederlandse wetgeving, met uitzondering van regels van internationaal privaatrecht of de tegenstrijdigheid van wetten die zou leiden tot de toepassing van enige andere wetten . Elk geschil tussen de onderneming en de klant of een andere persoon die voortvloeien uit, verband houden met of met betrekking tot Scramble webshop of Scramble website, deze 'Algemene Voorwaarden', of andere relevante zaken moeten worden opgelost voor een rechtbank in Nederland, en klanten leggen zich onherroepelijk neer bij de exclusieve bevoegdheid van deze gerechten ten aanzien van een dergelijk geschil of zaak. Voor zover toegestaan door de wet stemmen klanten er mee in, dat elke claim of actie door klanten, die voortvloeien uit, verband houden met, of in verband gebracht worden met het gebruik van Scramble websites, of deze 'Algemene Voorwaarden' alleen op individuele basis zal worden uitgevoerd en niet als een gezamenlijke, geconsolideerde of vertegenwoordigende actie. Als om welke reden dan ook een vordering uitmondt in een rechtszaak in plaats van in arbitrage, doen klanten afstand van enig recht op een juryrechtspraak.
Sectie 4. Aanbod: Goederen en diensten
• Aangeboden goederen en diensten zijn geregistreerd in de Scramble webshop database.
• De Scramble websites zijn intern gekoppeld aan de Scramble webshop database.
• Goederen worden aangeboden en digitaal weergegeven op de Scramble website.
Sectie 4a. Vrijwaring (Disclaimer)
• Prijzen: Goederen en diensten kunnen per ongeluk verkeerd zijn geprijsd. Eventuele fouten zijn onbedoeld. Scramble kan niet worden verplicht om goederen of diensten tegen een onjuiste prijs te leveren.
• Kennelijke fouten of vergissingen in de beschrijving of presentatie van de aangeboden goederen zijn niet bindend voor Scramble webshop.
Sectie 4b. Prijzen
• Goederen in Scramble webshop worden aangeboden met prijzen uitgedrukt in Euro's inclusief de toepasselijke BTW en zonder BTW.
• Goederen en diensten kunnen per ongeluk verkeerd geprijsd zijn. Eventuele fouten zijn onbedoeld. Scramble webshop kunnen niet verplicht worden om goederen of diensten tegen onjuiste prijzen te leveren.
Sectie 5. Belasting
• Alle leveringen binnen de Europese Unie zijn belast met de Nederlandse BTW: 9% BTW voor boeken en tijdschriften en 21% BTW voor alle andere goederen en diensten.
• Scramble biedt producten en diensten aan inclusief BTW, ongeacht nationaliteit of land van herkomst of bestemming van de klant.
• Scramble biedt onder voorwaarden (*) producten en diensten vrij van BTW aan geverifieerde BTW geregistreerde bedrijven die gevestigd zijn in de Europese Unie, buiten Nederland.
• Scramble berekent BTW op goederen en diensten (inclusief verzendkosten) geleverd aan personen met vestiging of afleveradres binnen de Europese Unie.
• Scramble berekent geen BTW op goederen en diensten geleverd aan geverifieerde BTW geregistreerde bedrijven met vestiging in de Europese Unie, buiten Nederland.
• Scramble berekent geen BTW op goederen en diensten (inclusief verzendkosten) geleverd aan personen of bedrijven met vestiging of met afleveradres in landen buiten de Europese Unie.
• Klanten met vestiging of afleveradres in landen buiten de Europese Unie zijn zelf verantwoordelijk voor de juiste invoer documenten en vergunningen en voor de betaling van de invoerrechten, belastingen en invoerhandelingen.
(*) Klanten zijn bevoegde vertegenwoordigers van het bedrijf en kunnen zich aldus identificeren.
6. Scramble webshop
Sectie 6a. Algemeen:
• Producten, inhoud en specificaties: Alle functies, inhoud, specificaties, producten en prijzen van producten en diensten beschreven of afgebeeld op Scramble website, zijn onderhevig aan veranderingen op elk moment zonder voorafgaande kennisgeving. Bepaalde maten en vergelijkbare beschrijvingen zijn bij benadering en zijn bedoeld om het gemak te dienen. Afbeeldingen van producten en diensten dienen ter illustratie van aangeboden producten en diensten. Al het redelijke wordt gedaan om de kenmerken van de producten, met inbegrip van de toepasselijke kleuren nauwkeurig weer te geven. De specificaties en kleurmogelijkheden van de gebruikte beeldschermen kunnen oorzaak zijn dat de echte kleuren anders zijn dan op het scherm werd ervaren. Kleur, textuur of detail van de getoonde producten kan afwijken van de actuele producten. Al het redelijke wordt gedaan om de producten nauwkeurig te beschrijven. Beschrijvingen kunnen onvolledig of verouderd zijn.
• Beschikbaarheid: De opname van producten of diensten op de Scramble website op elk willekeurig moment impliceert of garandeert niet dat deze producten of services daadwerkelijk ten alle tijden beschikbaar zullen zijn.
• Tikfouten: Informatie op Scramble website kan tik- of schrijffouten, onjuistheden of weglatingen bevatten die betrekking kunnen hebben op productbeschrijvingen, prijzen, promoties, aanbiedingen en beschikbaarheid.
• Correcties: Scramble behoudt zich het recht voor om ten alle tijden zonder voorafgaande kennisgeving eventuele fouten, onjuistheden of omissies te corrigeren en informatie te wijzigen of te actualiseren of bestellingen te annuleren wanneer informatie op de website onjuist is (ook nadat online bestelling is geplaatst).
• Nauwkeurigheid van informatie. Scramble tracht om ervoor te zorgen dat informatie op Scramble website volledig, juist en actueel zijn. Ondanks de inspanningen van Scramble, kan de informatie op Scramble website af en toe onjuist, onvolledig of verouderd zijn. Scramble geeft geen garantie met betrekking tot de volledigheid, juistheid of actualiteit van de informatie op Scramble website. Bijvoorbeeld, producten die zijn opgenomen op de Scramble website kunnen niet beschikbaar zijn, kunnen over andere eigenschappen beschikken dan die genoemd zijn, of een andere prijs hebben dan vermeld op Scramble website. Bovendien kan Scramble prijzen en beschikbaarheid aanpassen zonder voorafgaande kennisgeving. Hoewel het voor Scramble gebruikelijk is om bestellingen te bevestigen via e-mail, betekent de ontvangst van een e-mail met orderbevestiging niet automatisch Scramble’ aanvaarding van een bestelling of een bevestiging om een product of dienst te verkopen. Scramble behoudt zich het recht voor om zonder voorafgaande kennisgeving, de bestelde hoeveelheden van een product of dienst te beperken of te weigeren aan een klant. Scramble kan bevestiging van informatie verlangen voorafgaand aan de acceptatie en / of verzending van een bestelling.
• Het gebruik van Scramble website. Het ontwerp van de Scramble website en alle teksten, afbeeldingen, informatie, inhoud, en ander materiaal weergegeven op of die kunnen worden gedownload van Scramble website worden beschermd door auteursrecht, merkenrecht en andere wetten en mogen niet worden gebruikt, behalve als toegestaan in deze 'Algemene Voorwaarden' of met voorafgaande schriftelijke toestemming van de eigenaar van dergelijk materiaal. Het is bezoekers van de Scramble website niet toegestaan om de informatie of het materiaal dat kan worden gedownload van Scramble website op enigerlei wijze te reproduceren of openbaar te vertonen, uit te voeren, of te distribueren of anderszins dergelijke informatie of materiaal voor enig publiek of commercieel doel te gebruiken. Elk ongeautoriseerd gebruik van dergelijke informatie of materialen kan auteursrecht, merkenrecht, wetten op privacy en publiciteit, en andere wetten en regels overtreden.
• Linken naar Scramble website. Het creëren of het hebben van een link vanaf een andere website naar een pagina op de Scramble website zonder voorafgaande schriftelijke toestemming van Scramble is verboden. Het weergeven van Scramble website of informatie of materiaal weergegeven op Scramble website in frames of via soortgelijke middelen op een andere website zonder voorafgaande schriftelijke toestemming van Scramble is verboden. Eventuele toegestane links naar Scramble website dienen te voldoen aan alle van toepassing zijnde wetten, regels en voorschriften.
• Links naar andere websites. Van tijd tot tijd kunnen Scramble website links naar websites bevatten die geen eigendom zijn, beheerd of gecontroleerd worden door Scramble. Al dergelijke links worden aangeboden uitsluitend voor het gemak van de bezoeker. Wanneer bezoekers deze links volgen, verlaten ze Scramble website. Noch Scramble, noch één van aan Scramble gelieerde ondernemingen zijn verantwoordelijk voor de inhoud, materialen of andere informatie op of toegankelijk vanaf een andere website. Noch Scramble, noch één van aan Scramble gelieerde ondernemingen onderschrijven, garanderen, of geven waarborgen met betrekking tot andere websites of enige inhoud, materialen of andere informatie op of toegankelijk vanaf andere websites, of de resultaten die bezoekers kunnen krijgen van het gebruik van andere websites dan die van Scramble. Bezoekers' beslissing om toegang te krijgen tot andere websites gelinkt naar of van Scramble website, doen dat geheel voor eigen risico.
• Disclaimer: Het gebruik van Scramble website is voor eigen risico. De aangeboden informatie, materialen en diensten van Scramble website worden geleverd in de staat waarin ze zich bevinden zonder enige garanties van welke aard dan ook met inbegrip van garanties van verkoopbaarheid, geschiktheid voor een bepaald doel of niet-schending van intellectueel eigendom. Noch Scramble, noch een van haar gelieerde ondernemingen staat garant voor de nauwkeurigheid of volledigheid van de informatie, materialen of diensten die op of via Scramble website. De informatie, materialen en diensten aangeboden op of via Scramble website kunnen verouderd zijn, en noch Scramble noch gelieerde ondernemingen legt zich vast aan of aanvaardt enige verplichting om dergelijke informatie, materialen of diensten bij te werken. De voorgaande uitsluitingen van impliciete garantie zijn niet van toepassing voor zover bij wet verboden. Bezoekers worden verwezen naar hun lokale wetten voor een dergelijk verbod. Alle producten en diensten aangekocht op of via Scramble website zijn alleen onderworpen aan toepasselijke garanties van hun respectievelijke fabrikanten, distributeurs en leveranciers, voor zover beschikbaar. Voor zover binnen de grenzen van geldende wetgeving wijst Scramble alle aansprakelijkheid af van welke aard dan ook, expliciet of impliciet, inclusief eventuele impliciete garanties met betrekking tot de producten en diensten aangeboden door Scramble. Zonder beperking van de algemeenheid van het voorgaande, wijst Scramble hierbij uitdrukkelijk alle aansprakelijkheid af voor defecten aan een product als gevolg van normale slijtage, product misbruik, productaanpassingen, onjuiste product selectie, niet-naleving van codes, of verduistering . De voorgaande uitsluitingen van impliciete garantie zijn niet van toepassing voor zover bij wet verboden. Bezoekers worden verwezen naar hun lokale wetten voor een dergelijk verbod.
• Beperking van aansprakelijkheid: Scramble accepteert geen enkele verantwoordelijkheid of aansprakelijkheid voor eventuele schade aan of voor infectie door virussen van de computer, telecommunicatieapparatuur of andere eigendommen van bezoekers voortvloeiend uit bezoekers' toegang tot, het gebruik of browsen van Scramble websites, of bezoekers' downloaden van informatie of materialen vanaf Scramble websites. In geen geval zal Scramble, noch enige andere partij die betrokken zijn bij de creatie, productie of de transmissie van Scramble websites aansprakelijk zijn voor bezoekers of iemand anders voor enige indirecte, speciale, punitieve, incidentele schade of gevolgschade (inclusief, zonder beperking, die voortvloeien uit winstderving, verlies van gegevens of onderbreking van de bedrijfsvoering) die voortvloeien uit het gebruik, onvermogen tot gebruik, of de resultaten van het gebruik van Scramble websites, websites gekoppeld aan Scramble websites, of de materialen, informatie of diensten die op een of alle websites, hetzij op basis van garantie, contract of enige juridische theorie en hetzij al dan niet geadviseerd over de mogelijkheid van dergelijke schade.
• De voorgaande uitsluitingen van impliciete garantie zijn niet van toepassing voor zover bij wet verboden. Bezoekers worden verwezen naar hun lokale wetten voor een dergelijk verbod. In het geval van een probleem met de Scramble websites of enige inhoud, stemmen bezoekers er mee in dat de enige remedie is om te stoppen met het gebruik Scramble websites. In het geval van een probleem met de producten of diensten die klanten op of via Scramble websites hebben gekocht, stemmen klanten er mee in dat de enige remedie, voor zover van toepassing, gezocht dient te worden bij de fabrikant van dergelijke producten of de leverancier van dergelijke diensten, in overeenstemming met de garanties van dergelijke fabrikant of leverancier, of te vragen om terugzending en restitutie voor betreffend product of diensten in overeenstemming met het retours- en restitutiesbeleid geplaatst op deze website.
Sectie 6b. Aankopen op Afstand
Voorwaarden om tot een Aankoop op Afstand te komen (Order):
• Bestelling wordt door klant geplaatst door
1. Bevestiging door klant van bestelde goederen of diensten via Scramble website.
2. Acceptatie door klant van Scramble 'Algemene Voorwaarden'.
3. Volledige betaling door klant van het totaal bedrag gemoeid met de bestelling.
• Acceptatie door Scramble door
1. Bevestiging van ontvangst van bestelling door Scramble.
2. Bevestiging van ontvangst van betaling door Scramble.
• Bestellingen zonder volledige betaling van het verschuldigde totaalbedrag worden niet geaccepteerd en worden niet verwerkt.
• Scramble behoudt het recht voor om zonder opgaaf van redenen bestellingen of overeenkomsten te weigeren.
• Levering door Scramble volgt na totstandkoming van de koopovereenkomst.
• Bijdrage in de verzendkosten is afhankelijk van bestemming en omvang van de bestelling en is van toepassing op alle bestellingen anders dan afhaalbestellingen.
• Uitvoerige informatie over de bijdrage in verzendkosten is te vinden op de 'verzendkosten' pagina in de Scramble website. Zij vormen deel van deze 'Algemene Voorwaarden'.
Sectie 6c. Verwerking bestellingen
• Bestellingen worden tijdens openingstijden verwerkt.
• Verwerkings- en levertijden zijn indicatief en worden gerekend vanaf de datum van bevestiging van ontvangst van de volledige betaling.
• Mits alle bestelde goederen beschikbaar zijn, worden bestellingen binnen twee werkdagen verstuurd.
• Als slechts een deel van de bestelde goederen beschikbaar is, worden bestellingen binnen twee weken verstuurd indien ontbrekende artikelen binnen deze periode van tijd verwacht worden weer beschikbaar te zullen zijn.
• Als slechts een deel van de bestelde goederen beschikbaar is, worden bestellingen binnen vier werkdagen verstuurd indien de ontbrekende artikelen niet binnen een redelijke termijn of helemaal niet meer verwacht worden. Betaling voor ontbrekende artikelen wordt terug gestort.
• Bestellingen worden aangepast indien één of meer artikelen niet beschikbaar zijn. Betaling voor ontbrekende artikelen wordt terug gestort.
• Scramble is niet aansprakelijk voor gevolgschade of ongemak als gevolg van onjuiste of onvolledige informatie op Scramble website anders dan de terugbetaling van niet leverbare of geretourneerde artikelen.
Sectie 6d. Verzending
Alle bestellingen bij Scramble worden verzonden naar het door de koper opgegeven adres. Alle aankopen via de website van Scramble, zijn op grond van een verzendovereenkomst. Als gevolg daarvan gaat het risico van verlies en aanspraak van goederen besteld via de website van Scramble over op de klant bij overhandiging van de goederen aan de vervoerder. Klant is verantwoordelijk voor het indienen van eventuele claims met vervoerders voor beschadigde en / of verloren zendingen.
Verzending via postdiensten (PostNL)
• Postbezorging geschiedt onder de volledige verantwoordelijkheid van Nederlandse postdienst PostNL
• Pakket zendingen hebben geen betrouwbare traceer mogelijkheid.
• Brievenbus zendingen hebben geen traceer mogelijkheid.
• Scramble sluit nadrukkelijk alle verantwoordelijkheid en aansprakelijkheid uit in geval van schade, vertraging of verlies van goederen welke verzonden zijn per postdienst.
Sectie 6e. Geretourneerde zendingen
• Het is verantwoordelijkheid van de klant om dergelijke maatregelen te nemen zodat pakket op het afleveradres geaccepteerd en voor ontvangst getekend zal worden of tijdig opgehaald op het door de klant aangewezen afhaalpunt.
• Niet af te leveren of niet afgehaalde pakketten worden geretourneerd naar Scramble.
• Scramble berekent de retour verzendkosten en eventueel van toepassing zijnde invoerrechten door aan de klant.
• Extra verzend- of afleverpogingen zijn volledig voor rekening en verantwoordelijkheid van de klant.
Sectie 6f. Garantie en reclamaties:
• Artikelen welke via Scramble worden aangeschaft zijn vrij van gebreken, tenzij anders aangegeven of verondersteld mag worden.
• Reclamaties dienen onmiddellijk en uiterlijk binnen 48 uur na levering of afhalen gemeld te worden aan Scramble.
• Wettelijke garantietermijn voor goederen gekocht door inwoners van landen die deel uit maken van de Europese Unie is 2 jaar na aankoop.
• Een beroep op garantie na 2 jaar wordt uitsluitend in behandeling genomen in overeenstemming met de garantietermijn en -bepalingen zoals door de producent gehanteerd.
• Garantietermijn voor goederen gekocht door inwoners van landen die geen deel uit maken van de Europese Unie is gelijk aan de garantietermijn zoals gehanteerd door de producent van deze goederen.
• Garantie vervalt zodra niet langer op de producent een beroep kan worden gedaan door faillissement of staken van productie.
• Gereclameerde defecten zullen door Scramble of haar leveranciers kosteloos gerepareerd of vervangen worden. De garantie is beperkt tot de reparatie of vervanging van het defecte onderdeel of product en sluit vergoeding van verzendkosten of invoerrechten nadrukkelijk uit.
• De garantie is niet geldig indien naar het oordeel van Scramble het defect of de schade te wijten is aan normaal te verwachten slijtage, een ongeluk, oneigenlijk gebruik, of het gevolg van onderhoud of modificatie door anderen dan Scramble goedgekeurde instantie.
• Scramble is niet verantwoordelijk of aansprakelijk voor gevolgschade.
• Klant dient zich te realiseren dat vervanging van beschadigde, verloren of defecte goederen niet altijd mogelijk is.
Sectie 6g. Herroepingsrecht
• Voor bestellingen en leveringen aan particulieren geldt dat deze particulieren het recht hebben om binnen 14 dagen een artikel retour te sturen (herroepingsrecht).
• De herroepingstermijn verstrijkt 14 dagen na de dag waarop het artikel werd afgeleverd.
• Gebruik maken van het herroepingsrecht kan door dit binnen de gestelde termijn van 14 dagen kenbaar te maken aan Scramble en vervolgens de artikelen binnen 14 dagen te retourneren aan Scramble.
• Te retourneren artikelen dienen compleet te zijn inclusief alle geleverde toebehoren en in de originele staat en fabrieksverpakking.
• Retourzending dient gepaard te gaan met origineel of kopie van de meegeleverde factuur.
• Retourzending dient per koeriersdienst te geschieden op kosten van de klant.
• Retourzendingen per aangetekende post worden NIET geaccepteerd.
• Na ontvangst van de retourzending wordt het bedrag van de aankoop terug betaald.
• Verzendkosten worden niet vergoed.
• Er kan ook gebruik gemaakt worden van het modelformulier.
Sectie 6h. Cookies
Een cookie is een klein computer bestandje of een stukje informatie dat kan worden opgeslagen op de harde schijf van de computer van de bezoeker van websites. Scramble websites maken gebruik van cookies om de functionaliteit van de websites te verbeteren en in sommige gevallen, om bezoekers een op maat gemaakte online ervaring te bieden. Cookies worden op grote schaal gebruikt en de meeste web browsers zijn standaard ingesteld om cookies automatisch te accepteren. Bezoekers kunnen hun instellingen van internet browser veranderen om te voorkomen dat hun computer cookies accepteert. Het uitschakelen van cookies echter, zal de bezoekers verhinderen om een optimale prestatie van Scramble websites te ervaren. Door het gebruik van Scramble websites geven bezoekers toestemming voor het gebruik van cookies in overeenstemming met het privacy beleid van Scramble.
Sectie 6i. Klantenrekening (account)
Klanten die gebruik maken van Scramble diensten zijn verantwoordelijk voor het bewaken van de vertrouwelijkheid van hun account en wachtwoord en voor het beperken van de toegang tot hun computer, en accepteren de verantwoordelijkheid voor alle activiteiten die plaatsvinden onder gebruik making hun account of wachtwoord. Scramble biedt voor kinderen bestemde producten te koop aan, maar verkoopt deze aan volwassenen die producten kunnen kopen met een creditcard of andere toegestane betaalmethode. Als Minderjarige gebruikers van Scramble diensten doen dit uitsluitend onder supervisie van een ouder of voogd. Scramble behoudt zich het recht voor om diensten te weigeren, accounts te beëindigen, inhoud te verwijderen of te bewerken, of om bestellingen te annuleren naar eigen beoordeling.
Sectie 7. Product Disclaimer
Sectie 7a. Algemene Product Vrijwaring
De Vennootschap biedt alle diensten en informatie, materialen, producten (inclusief software) en overige diensten aan de klant aan op basis van staat waarin het zich bevindt en op basis van beschikbaarheid tenzij anders schriftelijk gespecificeerd. De Vennootschap geeft geen enkele garantie van welke aard dan ook, uitdrukkelijk of impliciet, met betrekking tot de werking van door Scramble of Scramble geleverde informatie, inhoud, materialen, producten (inclusief software) of andere diensten die op enigerlei wijze beschikbaar zijn gesteld aan de klant via Scramble of Scramble, tenzij anders schriftelijk vermeld. Klant stemt er uitdrukkelijk mee in dat bij het gebruik van de diensten en producten zoals geleverd door de Scramble of Scramble het risico van het gebruik volledig en uitsluitend bij de klant ligt.
Voor zover mogelijk volgens de toepasselijke wetgeving, verwerpt de Vennootschap alle garanties en voorwaarden, uitdrukkelijk of impliciet, waaronder, maar niet beperkt tot, impliciete garanties van titel, handelskwaliteit en geschiktheid voor een bepaald doel. De Vennootschap garandeert niet dat de diensten, informatie, inhoud, materialen, producten (inclusief software) of andere diensten van de Vennootschap die via zijn servers, elektronische communicatie of e-mail ter beschikking zijn gesteld vrij zijn van virussen of andere schadelijke componenten. De Vennootschap is niet aansprakelijk voor enige schade die voortvloeit uit het gebruik van de diensten van de Vennootschap of van enige informatie, inhoud, materialen, producten (inclusief software) of diensten die zijn opgenomen of anderszins ter beschikking gesteld aan de klant door middel van een dienst van de Vennootschap, waaronder , maar niet beperkt tot, directe, indirecte, incidentele, straf- en gevolgschade, tenzij anders schriftelijk vermeld.
Sectie 8. Privacy policy (opslag en gebruik persoonsgegevens)
De Vennootschap slaat namen, telefoonnummers, e-mailadressen van de klanten op voor administratieve en commerciële doeleinden. Ze worden uitsluitend gebruikt door Scramble en zullen in geen geval aan derden worden verstrekt. Ze worden opgeslagen op eigen beveiligde servers van de Vennootschap of die van een derde partij. De Vennootschap zet zich in voor het behoud van de nauwkeurigheid, vertrouwelijkheid en veiligheid van de persoonsgegevens van de klant.
· Introductie: De Vennootschap is verantwoordelijk voor bewaking en bescherming van de persoonsgegevens onder haar beheer.
· Doel van het inzamelen van gegevens: De Vennootschap verzamelt en gebruikt persoonlijke gegevens van de klant om door de klant gevraagde producten of diensten te leveren en om de klant eventueel te voorzien van extra diensten of andere producten waarvan het bedrijf meent dat de klant er wellicht in geïnteresseerd kan zijn. In bepaalde gevallen zijn de doeleinden waarvoor de persoonsgegevens worden gevraagd evident zoals het verstrekken van naam, adres en betaalgegevens als onderdeel van het bestelproces, en wordt instemming van klant met het verzamelen van deze gegevens verondersteld. Naam, adres, telefoonnummer en e-mail adres worden verstrekt aan bezorgdiensten waarvan de Vennootschap gebruik maakt om goederen te leveren. Deze bezorgdiensten zijn gehouden om deze gegevens uitsluitend te gebruiken voor de levering van goederen aan de klant en niet aan derden te verstrekken. In geval van levering van goederen aan ingezetenen van landen waarvan de autoriteit vereist dat gegevens verstrekt worden ten behoeve van invoer en heffingen, zullen factuur en in voorkomende gevallen daartoe bestemde persoonsgebonden registratie gegevens eveneens worden verstrekt aan de bezorgdienst.
· Account of klantenrekening: Iedere klant van het bedrijf beschikt over een eigen account waarin de volgende persoonlijke gegevens worden opgeslagen: naam en adresgegevens, telefoonnummer en e-mailadres (= gebruikersnaam), inschrijving nieuwsbrief, facturen van eerdere bestellingen. Klanten hebben recht op inzage, aanpassing en verwijdering van de opgeslagen persoonsgegevens. Dit kan middels bewerking van gegevens in de klantenrekening op de websites of door verzoek per e-mail of andere communicatiemiddelen.
· Toestemming: Kennis en toestemming zijn vereist voor de opslag, het gebruik of de openbaarmaking van persoonlijke gegevens, tenzij wettelijk vereist of toegestaan. Het verstrekken van persoonlijke gegevens aan de Vennootschap is altijd de keuze van de klant. Echter, kan de beslissing van de klant om bepaalde informatie niet te verstrekken de mogelijkheid beperken om klant producten of diensten van het bedrijf te leveren. De Vennootschap heeft geen toestemming nodig om informatie in te winnen of te gebruiken als voorwaarde voor de levering van een product of dienst, behalve wanneer deze toestemming vereist is om het product of dienst te kunnen leveren.
· Beperking opslag: De opslag van persoonlijke gegevens zal beperkt worden tot die gegevens die nodig zijn voor doeleinden zoals door de Vennootschap aangeduid. Met toestemming van de klant, kan de Vennootschap persoonlijke gegevens van de klant opvragen via telefoon, e-mail of internet.
· Beperking van het gebruik, informatieverschaffing en Retentie: Persoonsgegevens worden alleen gebruikt of verstrekt voor het doel waarvoor ze zijn verzameld, tenzij de klant anders heeft ingestemd, of wanneer het wordt vereist of toegestaan door de wet. Persoonlijke gegevens zullen worden bewaard voor de tijd die nodig is voor het doel waarvoor zij werden verzameld of dat wettelijk vereist is.
· Nauwkeurigheid: Uiterste zorg wordt besteed om de opgeslagen persoonlijke gegevens correct, volledig en up-to-date te bewaren voor gebruik waarvoor ze bedoeld zijn. De klant is zelf in de gelegenheid om zijn of haar gegevens in te voeren, aan te passen of onleesbaar te maken. In geval klant zijn of haar account evident onbruikbaar heeft gemaakt, heeft de Vennootschap het recht om deze ontoegankelijk te maken of geheel te verwijderen.
· Het waarborgen van klanten gegevens: Persoonlijke gegevens zullen worden beschermd door daartoe geschikte veiligheidsmaatregelen. De Vennootschap treft alle redelijke voorzorgsmaatregelen om ongeoorloofde toegang tot, gebruik of openbaarmaking van persoonlijke gegevens te voorkomen.
· Andere websites: Scramble websites kunnen links bieden naar andere websites van derden die niet onder dit privacy beleid vallen. Hoewel de Vennootschap er naar streeft om alleen naar websites te linken met hoge privacy-normen, zal dit privacy beleid niet langer van toepassing zijn zodra bezoekers de Scramble websites verlaten. Bovendien kunnen de Vennootschap en Scramble niet verantwoordelijk gehouden worden voor de privacy praktijken van websites van derden. Daarom wordt bezoekers geadviseerd om de privacyverklaring van dergelijke sites te onderzoeken om te weten te komen hoe deze omgaan met persoonlijke gegevens.
· Cookies: De websites van de Vennootschap maken gebruik van cookies voor de navigatie en de voortgang van het winkel proces. De meeste browsers zijn standaard ingesteld om cookies te accepteren, maar klant kan de browser opnieuw instellen om alle cookies te weigeren of om aan te geven wanneer een cookie wordt verzonden. Het is echter mogelijk dat sommige functies en services, op de websites van de Vennootschap, niet correct functioneren als cookies zijn uitgeschakeld in de browser van de klant.
Correspondentie: De Vennootschap bewaart alle inkomende en uitgaande correspondentie per post of elektronische communicatie op eigen beveiligde servers.
